What France’s PFAS Rules Mean for Clothing Worldwide

France’s new ban on PFAS in textiles and footwear marks one of the strongest consumer goods restrictions to date, raising questions about how “forever chemical” regulation could reshape global fashion markets.

Two days into the new year, France’s long-anticipated ban on per- and polyfluoroalkyl substances, more commonly known as PFAS or “forever chemicals,” officially entered force for consumer textiles, footwear, and related waterproofing agents. Under the implementing decree published alongside the law’s commencement, the restrictions are now solidified, but with a meaningful caveat: secondhand PFAS-treated garments remain exempt from the new regulatory scope and are permitted to circulate in France’s vibrant reuse market.

For consumers who have become accustomed to the soft sheen of weather-proof jackets or the stain resistance of performance sneakers, the shift will be noticeable but not overt. New products with PFAS above defined residual thresholds — chemicals once ubiquitous in water- and stain-resistant finishes — will be prohibited from manufacture, import, export, and sale beginning this year. But used apparel, with its legacy of PFAS application, will not be suddenly rendered unsellable or illegal.

French lawmakers and industry stakeholders recognized the tension between urgent environmental goals and circular-economy strategies that champion reuse and sustainability. Residual PFAS in existing garments cannot be feasibly removed, nor should perfectly serviceable clothes be consigned to landfill in the name of regulation. While the full ban will widen in 2030 to encompass all textiles, exceptions for essential uses and high-performance technical textiles remain under discussion.

The French decree applies immediately to consumer textiles, apparel, and footwear that contain PFAS above set thresholds. It is rooted in Law No. 2025-188, which the French Parliament adopted in February 2025 — one of the most comprehensive national steps against PFAS in consumer goods to date.

PFAS are part of a sprawling family of synthetic chemicals used for decades in products because they resist water, oil, and grease. This utility made them staples in textile finishes that help repel rain or stains, but those same traits mean they persist indefinitely in the environment and in human bodies.

The decree’s exemption of secondhand garments illustrates a broader regulatory dilemma: balancing aggressive toxics reduction with the need to promote reuse over disposal. This is not mere semantics; France and much of Europe are pushing circular-economy principles to reduce waste and carbon emissions. Restricting the trade of used clothing risks undermining those goals even as policymakers grapple with harmful legacy chemicals.

Across industries beyond fashion, PFAS — sometimes numbering in the thousands of distinct substances — show up in firefighting foams, food packaging, non-stick surfaces, and even personal care products. Regulatory scrutiny is intensifying not just in France but across Europe and North America. Denmark’s PFAS ban on clothing, footwear, and certain waterproofing agents took effect mid-2025, and many other European nations are advancing restrictions under frameworks such as REACH.

EU regulators are debating even more sweeping PFAS constraints on consumer products, reflecting continental concern about the group’s persistence and potential impacts on health, ecosystems, and recyclability.

Why PFAS matter to health, environment, and markets

For decades, scientists have raised concerns about the persistence and toxicity of PFAS. These chemicals do not break down easily in nature, accumulating in water, soil, and living organisms — including humans. The U.S. Environmental Protection Agency notes that exposure to certain PFAS may lead to serious health effects, including reproductive issues and increased risk of some cancers, among other outcomes.

Complicating the regulatory calculus is the sheer diversity of PFAS compounds and their varied uses; some fluorinated polymers are even embedded in medical devices because of their unique properties.

Yet scientists emphasize that PFAS’ environmental persistence has true consequences. According to research synthesized by Yale’s environment program, the chemicals’ near-indestructibility and widespread contamination — including drinking water supplies — are not theoretical risks; they are observable realities with documented health associations.

“We estimate there are more than 12,000 individual PFAS compounds, and unfortunately, for most of them, we have basically no understanding about toxicity,” Carsten Prasse, PhD, MSc, assistant professor in Environmental Health and Engineering, explained in a 2024 Johns Hopkins review. “I think the step by the EPA is really urgently needed to protect our drinking water and ultimately our health.”

The stakes for industry and markets are escalating in parallel. Analysts project that the PFAS alternative chemicals market — driven in part by regulatory shifts like France’s — is rapidly growing, with firms worldwide investing in substitutes that mimic PFAS’ performance without the persistent toxicity.

What’s Happening in the United States

If France’s new rules feel sweeping, the United States is already building its own patchwork version — one that mixes federal data collection with state-by-state bans that hit your closet faster than you might expect.

At the federal level, the most consequential move right now is not a nationwide apparel prohibition, but an attempt to define what the government can reliably see across the PFAS economy. On November 10, 2025, the U.S. Environmental Protection Agency proposed changes to its one-time PFAS reporting rule under the Toxic Substances Control Act, covering PFAS manufactured (including imported) at any point between 2011 and 2022. In its announcement, the agency said it wants the reporting program to be “more practical and implementable,” while reducing burden and still gathering key information about PFAS uses and effects.

EPA is also proposing to adjust the submission timeline and make technical corrections to clarify what must be reported in certain data fields. It spells out proposed exemptions and scope changes, including an exemption for imported articles (a category that matters enormously for fashion because so much apparel arrives as finished goods).

EPA Administrator Lee Zeldin framed the shift this way: “Today’s proposal is grounded in commonsense and the law, allowing us to collect the information we need to help combat PFAS contamination without placing ridiculous requirements on manufacturers, especially the small businesses that drive our country’s economy.”

Meanwhile, states are not waiting for federal harmony, and apparel is one of the clearer pressure points.

California’s Safer Clothes and Textiles Act (AB 1817), is a true marker: starting January 1, 2025, it restricts the manufacture, distribution, and sale of new textile articles that contain intentionally added PFAS, and it also sets a total organic fluorine limit of one hundred parts per million, dropping to 50 parts per million by January 1, 2027. The state built a runway for the hardest category, too: outdoor apparel for severe wet conditions has an extension until 2028, paired with disclosure expectations during the transition years.

California also moved earlier on children’s goods. AB 652 prohibits the sale of new juvenile products containing PFAS beginning July 1, 2023, a separate but telling signal of how aggressively the state has treated “forever chemicals” when the end user is a child.

New York’s approach is similar in spirit, slightly different in structure, and unusually consumer-facing in the way it’s been formalized. The New York State Department of Environmental Conservation explains that New York’s PFAS in apparel restriction applies to new apparel with intentionally added PFAS beginning January 1, 2025, while a later restriction specifically targeting outdoor apparel for severe wet conditions is keyed to 2028. In other words, it is not “no more rain jackets,” but it is “no more pretending the chemistry does not exist.”

Colorado’s SB24-081 lands in the same category of phased realism. The state’s own bill summary describes a disclosure requirement beginning in 2025 for outdoor apparel for severe wet conditions that contains intentionally added PFAS, followed by a broader ban timeline that culminates in 2028.

Maine is its own universe, because it treats PFAS as an economy-wide phaseout problem rather than a single-category cleanup. The state’s Department of Environmental Protection lays out the product-by-product schedule and makes clear that outdoor apparel for severe wet conditions sits in a special bucket, including disclosure language and a longer runway, within a broader shift that extends into the early 2030s.

Even without a single U.S. national apparel ban, large brands that sell in California, New York, Colorado, and Maine are being nudged into redesigning chemistry at the product development level, because building separate PFAS and non-PFAS supply chains for the same jacket gets expensive fast. In that sense, France’s national rule arrives to a market that is already learning how to live without the category defaults.

On the ground: what consumers can expect

For shoppers in Paris, Marseille, Lyon, and beyond, the immediate effects of France’s new PFAS textile ban may be subtle this year. The clothes, shoes, and gear lining store racks in 2026 will increasingly be free from PFAS above regulated limits, meaning rain jackets and outdoor apparel will soon rely on alternative repellency technologies — often silicone, water-based, or bio-derived finishes — to compete in performance and style. Regulatory and industry guidance highlight that as PFAS restrictions mount, “transitioning to safer PFAS-free alternatives won’t happen overnight,” and brands and manufacturers are actively exploring these replacements to stay ahead of tightening standards.

Even so, the vibrant second-hand clothes markets — from local vintage boutiques to online resale platforms — will continue to bustle with PFAS-treated garments for the foreseeable future. Retailers and sellers are not obliged to pull pre-existing items off shelves simply because they contain legacy PFAS, which could remain in older water-repellent garments and outdoor gear. This carve-out, while paradoxical, may ease the transition for consumers and brands alike, avoiding abrupt disposal of perfectly wearable clothing even as the industry shifts toward new chemistries.

France’s decree also sends a signal to global brands with supply chains in Europe: compliance in one major market increasingly means rethinking material sourcing, testing, and design at the outset. The French approach — comprehensive, phased, and context-sensitive — could serve as a template — or a pressure point — for multinational policymakers and industry stakeholders alike.

But beyond France, parallel developments in the United States underscore how deeply this regulatory wave is reshaping apparel markets. In this patchwork landscape, many global brands have begun to rethink product chemistry at its design stage so that a jacket sold in Tokyo, Los Angeles, or Paris can meet all of these evolving legal thresholds without fragmenting supply chains.

Industry voices argue that shifting away from PFAS is not solely about regulatory compliance but about consumer trust and future-proofing fashion. “The functionality that PFAS provide — a more stain-resistant coat or more breathable yet water-resistant gym shorts — is not necessary and certainly not worth the health risks,” said Sujatha Bergen, co-author of the NRDC’s 2025 report on PFAS in apparel, highlighting the growing ethical pressure on brands to innovate away from these chemicals. “We lived just fine without these chemicals before, and brands could phase them out quickly if they chose to.”
